Intellectual Property Notice
Rights to artwork remain the sole property of Tahlia Stanton PTY LTD including after purchase. This includes the purchase of originals, commissions, prints and current and/or future reproductions of any kind. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.
Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.
Liability
We are not liable for goods once they are in the possession of the collector. It is not our duty to refund, exchange, replace or compensate by any means for the damage of products that have been mishandled by customers. For example: smudging fingerprints on the white border, tearing fine art prints, damaging works, etc.
As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched. Every print is inspected several times before clearing quality control for shipment and only pristine purchased reproductions are packaged for you to enjoy.
Please read the product descriptions thoroughly and carefully. It is not our duty to compensate customers who do not read the information provided in the product description prior to purchase. All prints come with borders that are included in the final size of the listing.
European Union "Cooling-Off" Period
In accordance with applicable European Union (EU) consumer protection legislation, customers residing within the EU who purchase goods or services online may be entitled to cancel their purchase within fourteen days of receiving the goods, without providing a reason. This period is commonly referred to as the "cooling-off period."
Where applicable, customers must notify the Studio of their intention to withdraw from the purchase within the 14-day cooling-off period. Returned goods must be sent back promptly and in their original condition.
The customer shall be solely responsible for all costs associated with returning goods to the Studio, including but not limited to shipping, postage, insurance, customs duties, taxes, and any related fees. The Studio will not reimburse or contribute towards return shipping expenses.
Pursuant to Article 16 of the Consumer Rights Directive and any applicable implementing legislation, the right of withdrawal does not apply to commissioned works, bespoke goods, personalised items or other products exempt from withdrawal rights under applicable law.
The customer shall be liable for any diminished value of the goods resulting from handling beyond what is reasonably necessary to establish the nature, characteristics, and functioning of the goods. Due to the delicate nature of fine art products, returned artworks and art prints must be received in original, saleable condition. Any evidence of damage, excessive handling, wear, creasing, folded corners, tears, scratches, staining, mounting, framing, alteration or other deterioration may result in the return request being denied or an appropriate deduction being made from the refund amount where permitted by law.
Where a return is accepted, refunds will be processed in accordance with applicable consumer protection legislation following receipt and inspection of the returned goods.
Returns, Replacements and Refunds
If there is an issue with your order, we will work with you in good faith to resolve the matter as promptly as possible. If an item arrives damaged, defective, incorrect, or otherwise does not conform to your order, please contact the Studio with relevant photographs and details so that an appropriate resolution can be arranged.
The Studio makes every reasonable effort to ensure that artwork photography accurately represents the colours and appearance of each piece. However, colours may vary between devices due to differences in monitor, screen, and display calibration. Such variations do not constitute a fault or defect in the product. Customers concerned about colour accuracy are encouraged to view product images across multiple devices before purchasing.
Except where otherwise required by applicable consumer protection legislation, customers are responsible for all costs associated with returning goods to the Studio, including shipping, postage, insurance, customs duties, taxes, and any related fees. Return shipping costs will only be covered by Tahlia Stanton Pty Ltd where the item is determined to be faulty, damaged in transit, incorrectly supplied, or where required by law.
To assist with order verification and replacement requests, all shipments include a packing invoice identifying the contents of the parcel. Where complimentary items, studio gifts, test prints, or misprints are included, these may be separately marked on the packing documentation. Customers requesting a replacement, refund, or investigation into missing items may be required to provide a photograph of the packing invoice supplied with the order, together with photographs of all contents received. Failure to provide reasonable evidence requested by the Studio may affect the assessment of a claim.
Any complimentary items, gifts, test prints, or misprints included with an order are provided at the Studio's discretion, carry no monetary value, and are not covered by replacement, exchange, refund, or consumer guarantee obligations except where required by law.
Shipping Policy
Estimated processing and dispatch timeframes for each product are provided within the relevant product descriptions. While the Studio endeavours to dispatch all orders as promptly as possible, processing times may occasionally be extended during periods of exceptionally high demand, including but not limited to viral social media exposure, major sales events, product launches, or holiday periods. We appreciate your patience and understanding should such delays occur.
Customers are responsible for ensuring that all shipping information provided at checkout is complete, accurate, and current. Requests to amend a shipping address must be submitted within twenty-four (24) hours of purchase. While the Studio will make reasonable efforts to accommodate address changes requested within this timeframe, changes cannot be guaranteed once order processing has commenced.
Once an order has been dispatched, the Studio is unable to alter the delivery address and accepts no responsibility for parcels delayed, lost, misdirected, returned, or otherwise undelivered due to incorrect or incomplete shipping information supplied by the customer.
Where an order is returned to the Studio due to an incorrect, incomplete, or undeliverable address provided by the customer, the customer will be responsible for any additional shipping costs incurred to resend the parcel.
If the customer elects to cancel the order after it has been returned to the Studio, any refund issued will exclude all shipping and handling costs incurred by the Studio. In addition, a restocking fee of twenty percent (20%) of the purchase price may be deducted from the refund to cover administrative, processing, packaging, and restocking expenses, to the extent permitted by applicable law.
Duties and taxes
The studio is operated in Victoria, Australia and is not liable for import fees on any products purchased. This includes but is not limited to the commissioning of a custom piece, originals and fine art merchandise.
Any applicable taxes and duties are not included in the checkout total. These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges, so that the shipment can continue to its destination.
It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to us. Provided that the product is in its original condition, we will refund you the cost of your purchase (minus the costs of shipping to your country).
Items are declared at purchase value for exporting and under no circumstance will documents be falsified at your request.
